Section 7
Maximum extent of land to be held as a landholder
 (1) A person or his family as a landholder shall be allowed to hold land in the following areas in Nepal to the extent not exceeding 10 bighas:
(a) In the entire Terai region including inner Madhesh - 10 bighas.
(b) In Kathmandu Valley – 25 plantations.
(c) In all hilly areas except Kathmandu valley - 70 plants.
(2) Notwithstanding anything written in sub-section (1), a person or his family may keep as much land as is necessary for household purposes in addition to the land written in sub-section (1) so as not to exceed the extent written below:
(a) In the entire Terai region including inner Madhesh - 1 bigha.
(b) In Kathmandu valley – 5 plants.
(c) In all hilly areas except Kathmandu Valley – 5 plants.
(3) In respect of any land in the area to which sub-sections (1) and (2) are applicable, the right of the owner of the land shall not be transferred by sale, donation, lease in lieu or any other transaction to anyone other than the owner or sharer who is entitled to a share under the laws of Nepal in force before the commencement of those sub-sections. If the deed of relinquishment has not been registered till the date of commencement of those sub-sections and if the relinquished land including other lands remaining with him or his family exceeds the maximum limit written in sub-sections (1) and (2), then such right For the purpose of this clause, the alienated will not be recognized and this clause shall apply as if such land right remained with the alienating landowner. However, this sub-section shall not be applicable if the claim for registration has been passed before this section comes into effect.
(4) In the areas to which sub-sections (1) and (2) are applicable, any land owner who owns more than the maximum amount of land that can be held in accordance with those sub-sections until the date of commencement of those sub-sections with himself or his family, after the commencement of those sub-sections, such land shall be entitled to a portion according to the laws of Nepal. If the right has been relinquished by sale, donation, leasing or any other person, the written register of the transaction"Irrespective of whether or not such transaction has been passed, such transaction shall not be recognized for the purpose of this section and this section shall apply as if such land remained with the owner of the land who transferred the right. But this sub-section shall not apply in respect of donations made by any person on behalf of a public educational institution.
(5) For the purpose of sub-section (1), in the case of land that is encumbered, half of the land owner and encroachment shall be calculated.
(6) Notwithstanding anything written elsewhere in this section, in the case of the land owner whose delimitation action has yet to be decided on the former until the date of commencement of this section, the maximum delimitation according to this section will be applied only after the action related to the delimitation of the land to be held according to the provisions of the former is completed.
(7) According to section 13, the land that exceeds the limit should be retained by the office until the limit investigation is completed.
(8)- Notwithstanding anything written in sub-section (7), even if the land delimitation inquiry is not concluded, it shall not be a hindrance to the distribution of his share in the Sojagga by Mohi in accordance with the Act.
